1. Acceptance of Policy

This Consumer Health Privacy Policy supplements our Privacy Policy, which continues to apply. This Consumer Health Data Policy provides additional details about how Simple HealthKit, Inc. (“Simple HealthKit” or “we”) handles consumer health data in compliance with the specific requirements of the Washington My Health My Data Act, Nevada’s Consumer Health Data Privacy Law, and Connecticut’s Consumer Health Data Amendments to the Connecticut Data Privacy Act. 

The date listed at the top of this policy shows the last time it was updated. Simple HealthKit may make changes to this policy at any time. If you have any questions about this policy, please email privacy@simplehealthkit.com.

Consumer Health Data We Collect

    Simple HealthKit may collect ‘Consumer Health Data’ as defined by the applicable regulations. This data may include data linked or reasonably linkable to a consumer that identifies the consumer’s past, present, or future physical or mental health status but does not include publicly available data, deidentified data, or data explicitly excluded from coverage by the regulations.

    The Consumer Health Data we collect depends on your interaction with our Services and your choices, including your privacy settings, products and features you use, your location, and applicable law. Because Consumer Health Data is defined broadly, many of the categories of data we collect could also be considered Consumer Health Data. We will only collect data about you that is necessary for one or more of our Services or as required by law. Examples of Consumer Health Data we may collect include:

    • Health Conditions and Treatments: Information about individual health conditions, treatments, diseases, or diagnoses.
    • Medical Procedures and Medication: Data related to medical procedures, use or purchase of prescribed medication, and other health-related information.
    • Biometric Data: Genetic, physiological, behavioral, and biological characteristics or activity patterns used to extract a template or other identifier or identifying information, such as fingerprints, faceprints, voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.
    • Precise Location Information: Data that could reasonably indicate a resident’s attempt to acquire or receive health services or supplies.
    • Psychological and Behavioral Data: Information related to social, psychological, behavioral, and medical interventions.
    • Inferences: Drawn from other personal data, such as a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

    We comply with state-specific laws prohibiting using geofencing techniques within a specified proximity of healthcare facilities to collect or share Consumer Health Data.
